  • It does not complete your return-to-duty process.
  • The certificate you earn is not the only thing your employer needs to return you to a safety-sensitive job.
  • It does not provide mental health counseling or substance use treatment. If you need counseling or treatment, we’ll provide resources to help you find qualified support in your area.

How does this work?

This course is for education only. It does not provide mental health therapy, information on specific mental health disorders, medications, or treatment, but we will provide some information on how to find that type of help. If you have mental health questions, talk to a licensed mental health therapist.

The following is brief overview of the return to duty process.

1. Immediate Removal from Safety-Sensitive Duties

After violating DOT drug and alcohol regulations, your employer is required under 49 CFR Part 40 to immediately remove you from any safety-sensitive functions.

You will be informed that completing the SAP return-to-duty (RTD) process is mandatory before you can return to work.

The employee must be evaluated by a qualified Substance Abuse Professional (SAP). The SAP assesses the employee’s condition and determines the necessary treatment and education requirements. Once this step has been completed you must comply with your SAP’s recommendations, and you cannot switch to another SAP.

You must complete all steps in your SAP’s plan before you will be cleared to return to work.

Your treatment plan may include any or all of the following:

Drug and alcohol education
Outpatient counseling
Inpatient treatment (if necessary)
Substance abuse support groups
Your SAP will oversee your progress and confirm compliance. Our courses are designed to support you as a part of your recommendations.

Once you complete your treatment and education program, you will meet with your SAP for a follow-up evaluation.

If they determine that you have met all requirements, they will issue a report stating that you have met the requirements to become eligible for the return to duty drug test.

This report will be sent to your employer and uploaded into the FMCSA Clearinghouse (CDL Drivers).

You must take a DOT return-to-duty drug and alcohol test under direct observation.

A negative RTD test result is required to move forward.

Once you return to safety sensitive duty, you will be required to take a minimum of 6 tests in the first 12 months. Your follow up testing plan may last anywhere from 12 months(minimum) and up to 60 months (maximum) These tests are facilitated by your employer under the guidance of your SAP. All Return to duty and Follow up testing must be conducted under direct observation.
